Dear Clients and Colleagues,
The U.S. Department of Education’s Office for Civil Rights (“OCR”) recently began checking compliance with the 2020 Title IX Regulation’s requirement to post training materials. The final Rule requires academic institutions to post training materials from Title IX training:
“All materials used to train Title IX Coordinators, investigators, decisionmakers, and any person who facilitates an informal resolution process. A recipient must make these training materials publicly available on its website, or if the recipient does not maintain a website the recipient must make these materials available upon request for inspection by members of the public.” 85 Fed. Reg. 30578 (May 19, 2020).
Click here to read a more detailed explanation of this requirement. Our team recently heard from OCR who suggests the portion of the website where training materials are posted should be labeled, “Materials used to Train Title IX Coordinators, Investigators, Decision-makers and Any Person Who Facilitates an Informal Resolution Process.” The term “materials” is interpreted to mean PowerPoint presentations and handouts. It is not necessary to post the training videos themselves. Materials for different positions (e.g., coordinators, investigators) should be listed separately.
If your institution has attended trainings provided by Grand River Solutions, you have received emails with links to the materials that you can post for this purpose. If you need us to send the link again, please contact us. Additionally, OCR has webinars and resources publicly posted that may be reviewed. These are linked below.
If there is anything that Grand River Solutions can do to support you or your team in ensuring compliance with this, or any, section of the regulations, please let us know. The Grand River Solutions team is happy to provide support with building this section of your website, including organization of a page dedicated to training materials.
