The U.S. Department of Education’s Office for Civil Rights (“OCR”) recently began checking compliance with the 2020 Title IX Regulation’s requirement to post training materials. The final Rule requires academic institutions to post training materials from Title IX training:
“All materials used to train Title IX Coordinators, investigators, decisionmakers, and any person who facilitates an informal resolution process. A recipient must make these training materials publicly available on its website, or if the recipient does not maintain a website the recipient must make these materials available upon request for inspection by members of the public.” 85 Fed. Reg. 30578 (May 19, 2020).
Our team recently heard from OCR who suggests the portion of the website where training materials are posted should be labeled, “Materials used to Train Title IX Coordinators, Investigators, Decision-makers and Any Person Who Facilitates an Informal Resolution Process.” The term “materials” is interpreted to mean PowerPoint presentations and handouts. It is not necessary to post the training videos themselves. Materials for different positions (e.g., coordinators, investigators) should be listed separately.
