On February 17, 2022, the Department of Education sent a draft of its proposed amendments to the Title IX regulations to the Office of Information and Regulatory Affairs (OIRA) for review. The Department has not revealed its exact changes to the public; however, it appears likely that it will modify, rather than wholly revise, the current framework for resolving sexual harassment claims, parts of which have gained significant support across the political spectrum.
Proposed regulations do not require any action, meaning that any rollout of changes to educational institution’s procedures will occur over a long window. The proposed regulations will be subject to public comment, and then the Department must review each response and draft a final rule.
